# Is my factory expansion a producer under India's construction and demolition waste rules, and what recycling target applies?

Under the Environment (Construction and Demolition) Waste Management Rules, 2025, in force from 1 April 2026, a producer is whoever is in charge of a project of 20,000 square metres built-up area or more. The schedule prints 25% of the previous year's waste for 2025-26, which may not apply, then 50%, 75% and 100% from 2028-29.

## Who is a producer, and what counts

- Producer: a waste generator who is occupier or in charge of a building or building complex project with a built-up area of 20,000 square metres and above.
- Counted for the target: debris such as cement concrete, bricks, cement plaster, stone, rubble, tiles and ceramics.
- Not counted: usable or resalable material such as iron, wood, plastic, metal and glass, which stays under the other rules.

## The target

The rules took effect on 1 April 2026, yet the schedule's first row is 2025-26. I did not find a sentence saying whether that row applies. Ask the Central Pollution Control Board (CPCB) how it treats it.

- 2025-26: 25% of the waste generated in year Y-1, for both re-construction and demolition projects.
- 2026-27: 50%. 2027-28: 75%. 2028-29 onwards: 100%.
- The schedule's note says the percentage applies to the recyclable waste as assessed by the local authority or development authority.

## What the producer does

1. Prepare a waste management plan for each project, covering waste from all streams, and submit it to the local authority for approval.
2. Register on the CPCB portal. CPCB issues the registration certificate within fifteen days of receiving the application.
3. Deposit the entire waste at a processing facility, or at an intermediate waste storage facility if no processing facility works. If you process on site, deposit the leftover.
4. Meet the target by buying certificates from a registered recycler. Where records mismatch, the lowest figure counts.

## How certificates are counted

Certificate quantity = quantity of processed product x conversion factor x weightage. The weightage is 1.2 for in situ recycling and 1 for off site. A certificate is valid for three years from the end of the financial year in which it was generated, and a producer may buy up to its liability plus leftover liability plus 5% of the current year's.

## The rule's example, then a target worked from it

- 100 tonnes of processed product, conversion factor 0.8: in situ 100 x 0.8 x 1.2 = 96 tonnes; off site 100 x 0.8 x 1 = 80 tonnes
- A project generated 4,000 tonnes of debris in 2026-27 (example). The 2027-28 target is 75% x 4,000 = 3,000 tonnes

The first line is the rule's own example. The 4,000 tonnes is mine, and the 75% applies to the recyclable part as the local authority assesses it.

## What Senseible does here

Senseible reads fuel invoices and electricity bills into records, so the diesel and power used on your site are on file. Aggregate, concrete and waste weights are not in those records, and these rules are filed on government portals.

Last reviewed 2026-11-05. Text is the April 2025 notification; the fifteen days for registration and the 1.2 in situ weightage were not checked against the gazette. CPCB issues guidelines and the portal; confirm how the 2025-26 row is applied.
