# How long does a producer responsibility certificate stay valid in India, and how much extra can a producer buy, for e-waste, batteries, used oil and construction waste?

Canonical: https://senseible.earth/answers/epr-certificate-validity-and-buy-limit-by-stream

An e-waste or used oil certificate is valid for two years after the end of the financial year it was generated, a construction waste certificate for three, a battery certificate for seven. Producers may buy this year's liability plus leftover liability plus a buffer: 5% for e-waste and construction waste, 10% for batteries and used oil.

## The numbers, stream by stream

- E-waste (E-Waste (Management) Rules, 2022): valid for two years from the end of the financial year of generation. Buying limit: current year liability, plus leftover liability of earlier years, plus 5% of the current year liability. Denominations: 100, 200, 500 and 1,000 kilograms.
- Batteries (Battery Waste Management Rules, 2022): certificates from a recycler or refurbisher are valid for seven years for meeting a producer's obligation. Buying limit: the same formula with 10%.
- Used oil (hazardous waste rules, Chapter VII): valid for two years from the end of the financial year of generation. Buying limit: the same formula with 10%. Denominations: 100, 200, 500, 1,000 and 10,000 kilograms.
- Construction and demolition waste (Rules, 2025): valid for three years from the end of the financial year of generation. Buying limit: the same formula with 5%. The text as I read it prints the denominations as 100, 200, 500 and 1,000 tonnes, where the other rules print kilograms. That looks like a drafting slip, so it is a question for the Central Pollution Control Board (CPCB): ask whether kilograms or tonnes is meant.
- Bulk waste generators (Solid Waste Management Rules, 2026): certificates generated by the local body in a year are valid for three years for meeting a bulk waste generator's obligation.

## Plastic packaging

The Schedule II guidelines for plastic packaging say certificates are category-wise and carry the processor's enterprise data. In the text I read I did not find a validity period or a buying buffer for plastic packaging certificates. Check the current guidelines on the Central Pollution Control Board (CPCB) portal before you plan purchases.

## Rules that apply in every stream

- Certificates are adjusted automatically against the earliest liability first, then extinguished.
- Where producer and recycler records differ, the e-waste text says the lower figure counts, and the used oil and construction texts are described the same way. I did not confirm that sentence in the plastic text and did not find it in the 2022 battery text.
- Battery and plastic rules say a surplus certificate is used only within the same category of battery or packaging.

## What this means for a calendar

A certificate bought and not used still ages. Two-year certificates need the most care: a certificate generated early in a financial year has the same end date as one generated at its close.

## Certificates generated during 2025-26

- E-waste or used oil, two years from the end of the financial year 31 March 2026: valid until 31 March 2028
- Construction and demolition waste, three years: valid until 31 March 2029
- Buying limit for a liability of 1,000 tonnes this year and 100 tonnes left over: e-waste 1,000 + 100 + 50 = 1,150 tonnes; batteries 1,000 + 100 + 100 = 1,200 tonnes

The dates are my arithmetic from the rule wording. The liabilities are examples. The battery rule says seven years without naming a start point.

## What Senseible does here

Senseible reads fuel invoices and electricity bills into records, so the diesel and power your site uses are on file. These rules are filed on government portals, outside Senseible's records.

Last reviewed 2026-11-05. The e-waste figures (two years, 5%, denominations, earliest liability first, lower figure counts) and the battery figures (seven years, 10%) in the 2022 texts were read in the gazette. The used oil, construction, plastic and bulk generator figures were not read line by line. CPCB can lay down other denominations. Confirm validity in the consolidated rule when you buy.
