Does CBAM apply to steel or aluminium imported under inward processing and then re-exported?

No, not for the share that leaves the EU. CBAM applies to goods released for free circulation, and goods under inward processing are not released while they stay in the procedure. If the steel or aluminium, or products made from it, are later released into the EU market, CBAM applies to the input quantity behind that release.

Why re-exported goods fall outside CBAM

The CBAM Regulation, (EU) 2023/956, defines import as release for free circulation under the Union Customs Code. Inward processing, under Articles 256 to 258 of the Union Customs Code, (EU) No 952/2013, lets a company bring in non-EU goods, process them and send the products out again without paying import duty. While the goods stay in the procedure they are not released for free circulation, so there is no CBAM import, no embedded emissions to declare and no certificates to surrender for them.

What happens when processed products are sold inside the EU

Article 2(1) of the CBAM Regulation brings in processed products made from CBAM goods under the inward processing procedure in Article 256 of the Union Customs Code. When those processed products are released for free circulation, the declarant reports the quantity of CBAM goods that were placed under inward processing to make them, with their embedded emissions, not the finished products. This applies even when the finished product is not itself a CBAM good, for example a machine part made from imported steel plate.

How to work out the quantity

  1. Take the rate of yield from the inward processing authorisation: how many tonnes of product come from each tonne of input.
  2. Find the quantity of processed products released for free circulation in the year, from the discharge records.
  3. Convert it back to input tonnes of CBAM goods, by CN code.
  4. Apply the embedded emissions per tonne of those inputs, from the producer's actual data or the EU default values.

Points customs teams often miss

The 2.2 t CO2e per tonne is an assumption for the arithmetic, not a default value. Use the producer's verified figure or the official default for the CN code.

What Senseible does here

Senseible does not handle customs procedures or decide which share of a shipment was released. Its CBAM cost calculator and CBAM data reports help an Indian producer prepare the embedded emissions figures an EU importer asks for, whichever customs route the goods take.
