Can a Swiss Pan-Euro-Mediterranean (PEM) preferential proof of origin prove origin for goods entering the European Union (EU) under Carbon Border Adjustment Mechanism (CBAM)?

In principle a preferential proof is not accepted as proof of non-preferential origin. For Swiss goods, a PEM proof may be used for CBAM if its rules are the same or stricter than the non-preferential rules, no cumulation was applied and the proof says so.

What the Commission says

The Commission's Questions and Answers (Q&A) 7.17, citing the EU Guidance on non-preferential rules of origin, say proof of non-preferential origin is all evidence submitted to support the declared non-preferential origin. A proof of preferential origin is in principle not acceptable as proof of non-preferential origin. It may be taken into consideration in verifying a declared non-preferential origin if the declarant can establish that the goods acquired preferential originating status under rules identical to those that decide country of origin under Article 60 of the Union Customs Code.

The three conditions for Swiss trade

  1. The preferential rules of origin are the same as, or stricter than, the non-preferential rules.
  2. No cumulation was applied.
  3. The information on non-cumulation is provided in the proof.

When EU goods are further processed in Switzerland

The Q&A describes a case where EU CBAM goods are used as materials in Switzerland and the processing is not enough to give Swiss non-preferential origin under the EU non-preferential rules, while the same processing gives Swiss preferential origin through cumulation under the PEM rules. For CBAM, those goods keep their EU non-preferential origin and are exempted from the CBAM provisions.

What this means for Indian material in a Swiss product

Our reading, not stated in the Q&A: if Indian steel gets only light processing in Switzerland, the non-preferential rules decide origin, not a PEM proof built on cumulation. Ask your Swiss customer which origin it will claim and on what evidence before you quote a CBAM-free price.

What Senseible does here

Senseible does not file customs or CBAM declarations and does not decide origin or who the declarant is. It reads an Indian plant's fuel invoices and electricity bills into dated, fingerprinted installation records, the plant-side data an EU buyer asks for.
