What is the penalty if a CCTS plant does not surrender enough certificates?
The Central Pollution Control Board imposes environmental compensation equal to twice the average price at which certificates traded in that compliance year's trading cycle, for the shortfall. BEE sets the average price. It is payable within 90 days, after a hearing, and non-payment draws Environment Protection Act penalties.
Rule 6 of the 2025 target rules
- Applies when a plant fails to meet its duties under Rule 4, such as achieving its target or surrendering certificates for the shortfall.
- Amount: twice the average traded price of a certificate in that compliance year's trading cycle, for the shortfall.
- BEE determines the average price.
- The plant must get a reasonable opportunity to be heard first.
- Pay within 90 days of the order, or face penalty under the Environment Protection Act, 1986.
- The money goes to a separate account used for the scheme on NSC-ICM's recommendation.
Missing paperwork costs too
If a plant fails to submit its documents, its achieved intensity is taken as its baseline intensity when the shortfall is worked out.
