Do India's e-waste rules cover a micro enterprise, or a factory that only uses a lot of electronics?

India's E-Waste (Management) Rules, 2022 apply to manufacturers, producers, refurbishers, dismantlers and recyclers, and leave out micro enterprises as defined in the 2006 enterprise development Act. A separate rule covers any entity that used at least 1,000 units of listed equipment in a year: it must hand e-waste only to registered parties.

Who the rules apply to, and who is left out

Rule 2 applies to every manufacturer, producer, refurbisher, dismantler and recycler involved in making, selling, transferring, buying, refurbishing, dismantling, recycling and processing e-waste or equipment listed in Schedule I.

The bulk consumer test

A bulk consumer is any entity that has used at least 1,000 units of the equipment listed in Schedule I at any point of time in the financial year. It includes an e-retailer. Rule 8 says a bulk consumer shall ensure its e-waste is handed over only to a registered producer, refurbisher or recycler.

A reading I cannot settle for you

Rule 2 names the roles it covers and lists the micro enterprise exclusion there. Rule 8 on bulk consumers is a separate rule. The text does not say in so many words whether a micro enterprise that is also a bulk consumer is outside rule 8. Ask your State Pollution Control Board in writing before you rely on the exclusion.

Storage while you wait for pickup

Rule 11 lets a manufacturer, producer, refurbisher or recycler store e-waste for no more than 180 days, with records, and the Central Pollution Control Board may extend that to 365 days for a process-development need. Bulk consumers are not named in that rule.

A factory floor count, example numbers

The counts are examples. Whether each item is in Schedule I is for you to check against the schedule.

What Senseible does here

Senseible reads fuel invoices and electricity bills into records, so the diesel and power your site uses are on file. These rules are filed on government portals, outside Senseible's records.
