Which surplus plastic packaging certificates can be used to offset which obligation under India's producer responsibility guidelines?

A surplus plastic packaging certificate stays in its own category. A reuse surplus can be set against reuse, recycling and end of life disposal; a recycling surplus against recycling and end of life disposal; an end of life surplus against neither reuse nor recycling. A temporary cross-category purchase rule is written to end with 2025-26, and I found no extension.

What a brand owner can do with a surplus

  1. Offset a previous year's shortfall, subject to the environmental compensation clause (paragraph 9.5).
  2. Carry it forward for use in the next year.
  3. Sell it to other producers, importers and brand owners.

The ladder between obligation types

Buying a surplus from someone else

Producers, importers and brand owners can meet an obligation under a category by buying a surplus certificate of the same category from other entities. The transactions are recorded on the Central Pollution Control Board (CPCB) portal when annual returns are filed.

The cross-category rule that lapsed

Paragraph 15A, added in October 2023, let CPCB allow certificates from a category with a surplus to be bought for a category in deficit, with CPCB setting the quantum from the availability and cost of collection, segregation and processing. Sub-paragraph 3 says it ceases to apply at the end of 2025-26. That date has passed. I found no later amendment extending it on the Ministry's rules page.

The tonnages are examples. The rules for what can offset what are the guidelines' own.

What Senseible does here

Senseible reads fuel invoices and electricity bills into records, so the diesel, fuel and power your site uses are on file. These rules are filed on government portals, outside Senseible's records.
