Does SECR apply to the UK subsidiary of an Indian company?

Yes, if the UK subsidiary passes two of three SECR tests on its own figures: turnover over £36 million, balance sheet over £18 million, more than 250 employees. These SECR limits did not rise with the April 2025 company size changes. An Indian parent does not exempt it.

Who SECR covers

Why the Indian parent does not change it

A subsidiary can skip its own SECR statement only when a UK parent includes it in a group energy and carbon report filed in the UK. An Indian parent files no UK directors' report, so that route is not open unless there is a UK intermediate holding company that prepares one. In that case the holding company reports for the UK group.

The low energy exemption

A large company that used 40,000 kWh of energy or less in the UK in the year does not have to give the figures, but must say in its directors' report that it is exempt for that reason. A small UK sales office may qualify; a factory or warehouse almost never will.

What the directors' report must contain

  1. UK energy use in kWh from gas, electricity and transport fuel, with business travel in company or employee-owned cars where the company buys the fuel.
  2. The greenhouse gas emissions from that energy, in tonnes CO2e.
  3. At least one intensity ratio, such as tonnes CO2e per £ million turnover or per employee.
  4. The methodology used, normally the UK government conversion factors for the year.
  5. Energy efficiency actions taken in the year, and prior year figures from the second year onwards.

What Senseible does here

Senseible reads energy bills and fuel invoices and keeps each figure tied to its document. For UK sites, the subsidiary applies the UK government conversion factors for the reporting year.

Last reviewed 2026-10-17. SECR tests (£36 million, £18 million, more than 250 employees) checked against professional summaries of the 2024 size threshold changes, which left SI 2008/410 Schedule 7 Part 7A unchanged; confirm paragraph 20B on legislation.gov.uk for the financial year being reported.
